Terms of Service

1. Acceptance of Terms

By accessing or using freightOptIQ ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

These terms apply to all users, including freight brokers, dispatchers, freight forwarders, logistics coordinators, and any other individuals or businesses using freightOptIQ.

2. Description of Service

freightOptIQ is a freight document automation platform that extracts structured data from freight documents including rate confirmations, carrier invoices, bills of lading, and related logistics paperwork. The Service uses AI to process documents submitted via email integration, file upload, or direct input.

3. Account Registration

You must create an account to use freightOptIQ. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when registering.

One account may not be shared among multiple users. Each user must have their own account.

4. Acceptable Use

You agree to use freightOptIQ only for lawful purposes. You must not:

• Upload or process documents you do not have the right to process
• Use the Service to process personal data of individuals without their consent
• Attempt to reverse engineer, decompile, or extract the AI models or source code
• Use automated scripts to abuse the Service beyond normal usage
• Resell or sublicense access to the Service without written permission
• Use the Service for any illegal activity

5. AI Accuracy Disclaimer

freightOptIQ uses artificial intelligence to extract data from freight documents. While we work to ensure high accuracy, AI extraction is not perfect. You are responsible for reviewing extracted data before relying on it for business decisions, payments, or legal purposes.

freightOptIQ does not guarantee the accuracy, completeness, or fitness for purpose of any extracted data. We are not liable for errors in extraction or for decisions made based on extracted data.

6. Billing and Payment

freightOptIQ offers a Free plan and paid plans (Starter at $49/month, Pro at $149/month). Paid plans are billed monthly. Payments are processed by Stripe.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time from the Settings page. No refunds are provided for partial months, except where required by law.

We reserve the right to change pricing with 30 days notice to existing subscribers.

7. Data and Privacy

Your use of freightOptIQ is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of all data you upload or process through freightOptIQ. By using the Service, you grant us a limited licence to process your data solely to provide the Service.

8. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. We may perform scheduled or emergency maintenance that temporarily affects availability. We are not liable for losses caused by service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, freightOptIQ and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of the Service.

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 3 months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account for violation of these Terms, non-payment, or for any reason with 7 days notice.

Upon termination, your access to the Service will cease. We will retain your data for 30 days after termination before deletion, during which you may request an export.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification with at least 14 days notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
